Reckless Driving Ticket in Waverly, VA Dismissed

The City of Waverly Police Department often write tickets on Rt. 460, taking advantage of the multitude of Speed Limit changes. Often times, a speed trap can be spotted within a short distance of a lower posted speed limit sign. As a result, many commuters are cited with both Speeding and Reckless Driving tickets. The City of Waverly is located within Sussex County; therefore, defendants charged with traffic offenses report to Sussex General District Court.

In this particular case, the defendant received a Reckless Driving ticket for going 69 in a 45. The charge began in Sussex General District Court , but due to the severity of the charge as well as the facts and circumstances of the case, we appealed to Circuit Court. During a trial in Sussex Circuit Court, I presented an argument which convinced the prosecution to drop the case.
