Reckless Driving 

If you are charged with reckless driving by speed, you need to know that it is not a simple speeding ticket. Speeding is a traffic infraction, whereas reckless driving is a criminal misdemeanor. That means that if you are found guilty of reckless driving, you will face the following consequences:

  • permanent criminal record that never goes away and can never be expunged
  • jail time up to one year
  • license suspension up to 6 months
  • fines up to $2500
  • insurance premium increase $5000-10000

Speeding tickets are traffic infractions and not a criminal misdemeanor. Many people who call me do not realize they are charged with reckless driving by speed, and not speeding. Virginia reckless driving is defined as driving OVER 80 mph OR 20 or more over the speed limit:
  • EXAMPLE: 81 mph in a 70 = RECKLESS DRIVING MISDEMEANOR
  • EXAMPLE: 80 mph in a 70 = SPEEDING (not a misdemeanor, not criminal) INFRACTION

While speeding is a traffic infraction, people still face the following consequences:

  • license suspension depending on the speed and state licensed
  • high fines
  • insurance increase premium $1000-$3000 on average among Geico, USAA, Progressive, State Farm, Farmers, and Nationwide
  • demerit points
