Is Reckless Driving in Virginia a Felony?

Daniel Leavitt • Aug 18, 2021
Reckless driving, in all of its forms, is a serious crime that should be avoided. It's a danger to you, and it's a danger to everyone you share the roadway with. However, it's not a felony in the state of Virginia. Instead, it's a Class 1 Misdemeanor. This doesn't mean it's no more consequential than parking at a meter for too long or getting into a fender bender, though. Reckless driving still comes with long-term consequences and a criminal record that may or may not be expunged; even if the case is dismissed.

If you've found yourself charged with reckless driving, whether you've committed the crime or not, you must seek out an attorney immediately.

 Here is why...

It's a Class 1 Misdemeanor

A misdemeanor may not sound that horrible, but a Class 1 Misdemeanor is the most serious misdemeanor in Virginia. It comes with a permanent criminal record if you're convicted of the crime, potential jail time, and long-term consequences we'll discuss soon.

Even worse, the crime may not be expunged from your record; even if you're found not guilty or the case is dismissed. This is because your eligibility to have the crime expunged is dependent on many different, intricate, factors that are unique to your specific case.

Navigating those details on your own, and getting the case expunged from your public record, can be extremely difficult. Also, not getting it expunged can leave you with long-term consequences for a crime you weren't even convicted of.

The Long-Term Consequences of Reckless Driving in Virginia

If you're found innocent, or the case is dismissed, your main long-term consequence is that potential employers, educational institutions, and other places can see that you were charged for the crime when they perform a background check. This may cause them to turn down your application despite the positive outcome of the case.

If you are convicted, the consequences are far worse.

As a Class 1 Misdemeanor, reckless driving will produce a permanent criminal record. Potential employers and current employers can see this whenever they perform a basic background check. This can prevent you from working for most employers and drastically impact the quality of your life.

Schools also gain access to your criminal record. This can keep you from being accepted to universities and colleges you're qualified for, and it can even result in you being expelled if you are a student currently.

Finally, you can be denied security clearance in all of its forms. This may be by your employer or any other establishment or institution. It can also keep you from getting high-paying security-based positions or finding a career in the legal field.

Get an Attorney

If you're facing reckless driving charges in Virginia, you do not want to face them alone. You need a trained professional who can navigate this complex arena and get you the best outcome possible.

Hiring an attorney may sound like a daunting or expensive task, but it can keep your life from spiraling out of control due to the consequences of a reckless driving conviction. An attorney can help you beat the charges, keep your future opportunities open, and help you have the case expunged from your record if you're found innocent or the case is dropped. More importantly, attorneys are willing to work with your financial situation, and the amount of time, stress, and long-term punishment they can save you are priceless.
