DUI 1st Reduced to Reckless Driving With No License Suspension; Hopewell, VA DUI Lawyer
Reckless Driving can be a serious charge; however, it is far less serious than a DWI conviction. DUI/DWI is under the Virginia criminal law code section whereas Reckless driving is written under the traffic section. Reckless driving is punished like a misdemeanor, however it is not under the criminal code section. In addition, DUI/DWI has a stigma about it that reckless driving does not have. That said, DUI/DWI carry mandatory penalties that reckless driving does not.
For instance, DUI/DWI 1st offense carries a MANDATORY license suspension of ONE YEAR, plus IGNITION INTERLOCK, plus VASAP, etc. And it often requires mandatory JAIL based on the blood alcohol content alone.
In this case, I was able to convince the prosecutor to AMEND the DUI/DWI 1st offense to reckless driving and my client did not have his license suspended.
