High Speed 101 MPH Dinwiddie, Virginia Reckless Driving

Reckless driving in Virginia is a serious charge for anyone due to the following:

  • it is a criminal misdemeanor
  • it can carry jail time
  • it can have employment consequences
  • insurance rates go UP quite a bit and many insurance companies drop you from coverage

Over 100 MPH is Even More Serious

It is pretty common to get lower speed reckless driving charges reduced. But once you reach a certain speed, it becomes very difficult to reduce. Our client had retained a DIFFERENT attorney for her case in lower court. Then she called me AFTER she was convicted. Her other lawyer negotiated the following result at 101 MPH:

  • CONVICTION for the misdemeanor reckless driving, 101 mph
  • JAIL TIME
  • FINE AND COSTS

Difficult Appeal in Dinwiddie Traffic Court

Appeals are never easy, but they are even more challenging when you are trying to improve the outcome of someone who PLEAD GUILTY and had a plea agreement. The reason is that you are going back on your deal, so to speak.

However, today I was able to negotiate the following result at 101 for my client in Dinwiddie Circuit Court:

  • REDUCED TO A SIMPLE TRAFFIC INFRACTION (not reckless driving and not a criminal misdemeanor)
  • LOW FINE FOR THE SPEED
  • NO JAIL TIME
  • NO LICENSE SUSPENSION
  • REDUCED TO THE LOWEST MOVING VIOLATION IN VIRGINIA

As you can see, the client was given TEN days in jail at 101 mph, with 9 days suspended so the client went to jail for a day and would have been on probation if she did not appeal.

OTHER ATTORNEY CASES IN DINWIDDIE, VA TRAFFIC COURT FOR RECKLESS DRIVING AT SIMILAR HIGH SPEEDS

Note, this was a LOWER SPEED and their client’s license was suspended for SIX MONTHS with NO RESTRICTED LICENSE. In addition, they PAID A FINE OF $1000. See another case that was reduced, but just barely:

Again, we see another $1000 fine plus court costs. This charge was reduced, but the SPEED WAS KEPT THE SAME. So the client’s driving record will still show 102 MPH in a 70!! Every case is different and past results do not predict the future.
